Ghost Chatter Terms of Use

Introduction

Welcome to Ghost Chatter LLC ("Ghost Chatter," "we," "our," or "us"). These Terms of Use ("Terms") govern your use of the Ghost Chatter mobile application ("App") on iOS and Android and any related services provided by us, including Ghost Chatter Network—our in-app platform for live and on-demand discovery, streaming, chat, and related social features.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

YouTube Terms of Service. By using features that integrate with YouTube (such as live streaming and chat), you also agree to the YouTube Terms of Service.
Apple App Store (iOS). If you obtained the App through the Apple App Store, your use of the App is also subject to Apple’s Licensed Application End User License Agreement.
Google Play (Android). If you obtained the App through Google Play, your use may also be subject to Google Play’s policies.

Acceptance of Terms

By accessing or using the App, you confirm that you accept these Terms and agree to comply with them. If you are using the App on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

Description of Service

Ghost Chatter is a paranormal investigation companion app.

Core features include:

Investigation modes (Chatter, Estes, Isolation, Spirit Box) and related session types
Question systems (pre-built and custom, where available)
AI voice tools, text-to-speech, and premium voices (where offered)
Recording (audio/video), including optional watermarks
Equipment tracking and progression (levels, achievements, leaderboards, where available)
Oracle (sensor-assisted and AI-assisted features, where available)—see Oracle Feature Terms
Ad-supported features (such as rewarded ads for free-tier benefits)—see Advertising Terms

Ghost Chatter Network includes:

Live streaming, including live guests and co-hosts, and simulcasting to supported third-party platforms (such as YouTube, Twitch, and Facebook) where supported
Viewing, discovery, and on-demand content, including replays, community clips, and Encounter short videos
Chat, comments, direct messages, interaction, and community features (including profile features)
Weekly leaderboards, winner borders, and Haunting Season—see Leaderboards, Winner Borders, and Haunting Season
Optional monetization (for example, Ghost Tokens, Gifts, highlighted chat, viewer flashlight control, creator memberships, and creator rewards)—see Live Gifts and Ghost Tokens (Virtual Items) and linked policies below

Some investigation features may be available without a registered account. Ghost Chatter Network features require a registered account and meeting the age requirements described below. You may browse some Network content without completing full registration.

Features may change or be discontinued at any time. We do not guarantee uptime, quality, or audience.

Audience Questions Feature

Viewers may submit questions during live streams.
Questions may be selected and audibly read using text-to-speech.
Submission does not guarantee selection.
All questions are subject to moderation.
Users are responsible for submitted content.

Eligibility and Age Requirements

18 and older — full access. You must be at least 18 years old to use all features of the App, including chatting, commenting, liking, following, direct messages, going live, guesting or co-hosting, uploading clips, sending Gifts, purchasing Ghost Tokens or Premium, earning or receiving creator rewards, and appearing on leaderboards or in Haunting Season rankings.
13 to 17 — watch-only, with permission. If you are 13 to 17 years old, you may use a watch-only account only if your parent or legal guardian has given permission. You confirm this during sign-up. See Watch-Only Accounts (Ages 13–17).
Under 13 — not permitted. You may not use the App or create an account if you are under 13. We do not knowingly collect personal information from children under 13; see our Privacy Policy.
Age of majority. Where the age of majority in your jurisdiction is higher than 18, references to "18" for purchases, payments and creator rewards mean that age.
Accurate age. You must give your real date of birth. We may use it, together with signals such as reports, account activity and device information, to apply the correct account type. Giving a false date of birth, or helping someone under the required age get around these rules, violates these Terms and may lead to suspension or termination. Once your date of birth is saved, it cannot be changed in the App; if it is wrong, contact info@ghostchatterapp.com.
Parents and guardians. By giving permission, a parent or guardian agrees to these Terms on the minor's behalf and is responsible for supervising the minor's use of the App. A parent or guardian may ask us to close a minor's account at any time by contacting info@ghostchatterapp.com.

Watch-Only Accounts (Ages 13–17)

A watch-only account can:

watch live streams, replays and clips, and browse Ghost Chatter Network;
report content or users (including child-safety reports) and block users;
manage its own profile basics, notification settings, and delete the account.

A watch-only account cannot: chat or comment; like or react; follow accounts; send or receive direct messages; go live, guest or co-host; upload clips or other content; send Gifts; purchase Ghost Tokens, Premium or any other item; earn, receive or cash out creator rewards; or appear on leaderboards or Haunting Season rankings (including winning leaderboard borders). Watch-only accounts are not shown in viewer lists, search or suggestions, show only a limited profile to others, and cannot be followed. We enforce these limits on our servers, and we may change the list of available features at any time.

When the account holder turns 18 (based on the date of birth provided), the watch-only limits are lifted automatically and the account gets full access under these Terms.

Ghost Chatter Network

Nature of Service

Ghost Chatter Network is provided for entertainment and community use. It is not a guaranteed broadcast, talent, or employment service.

User Content and License

You retain ownership of your content.
You grant us a worldwide, non-exclusive, royalty-free license to use, host, display, reproduce, modify, and distribute your content as reasonably necessary to operate the App and Ghost Chatter Network (including moderation, safety, and technical delivery).

Representations

You represent that you have the rights to your content and that your use complies with applicable laws and consent requirements (including for recordings, likeness, and location).

Encounter Videos and Community Clips

Users aged 18 and older may post Encounter short videos and other community clips to Ghost Chatter Network.
When you post, the App may ask you to choose a video type and optional location labels for your video. Choose labels that accurately describe your video. We may use labels to organize, recommend, and display videos, and we may change or remove labels.
Uploaded videos and their captions may be automatically scanned for content that breaks our rules. A video may be marked as sensitive, limited in who can see it, or hidden while our team reviews it. Automated scanning does not by itself ban or restrict your account.

User Accounts and Registration

You may use automatically generated usernames or create custom usernames where the App allows.
Registered accounts are required for Ghost Chatter Network features. Registration may use email and password, Sign in with Apple, or Google sign-in, as offered in the App. During registration you will be asked for your date of birth and to accept the terms that cover live and user-generated content features.
Custom usernames may require an email address for recovery.
Username guidelines (where applicable): typically 3–20 characters; letters, numbers, and spaces only; no profanity or inappropriate content; custom username change limits may apply (e.g., once every 7 days).
You are responsible for all activity under your account and for securing your login information. Notify us promptly of unauthorized use.
We may require you to complete or update registration before accessing certain features, even if you previously used the App without a registered account.
Sign out everywhere: you can sign out of your Ghost Chatter account on all of your devices from the App’s account settings.
Account deletion: you can permanently delete your account in the App (Profile Settings > Account > Delete account). See Termination and Account Deletion.

Live Streaming

Go Live is free. Live broadcasting on Ghost Chatter Network does not require a Premium subscription. It requires a registered account with full access (18+), acceptance of the live network terms, and meeting the Go Live requirements below.
Go Live requirements. Going live is available only to accounts that meet our current requirements, which may include a verified age of 18 or older, a minimum account age, a minimum number of public videos posted on more than one day, a waiting period after a date of birth is added, and no recent moderation actions. The App shows what is left to do when you tap Go Live. We may change these requirements, and may limit or remove Go Live access, at any time.
Guests and co-hosts must also have full-access (18+) accounts and follow these Terms.
You are responsible for your streams and for compliance with local laws regarding recording, streaming, privacy, and safety.
Do not stream illegal or unsafe content.
We do not guarantee uptime, quality, or audience.
For issues related to live streams (for example, reporting a live stream, live chat abuse, questions about going live, or live safety or moderation concerns), contact live@ghostchatterapp.com.

Simultaneous Streaming

If you stream or simulcast to third-party platforms (such as YouTube, Twitch, or Facebook), you must comply with each platform’s terms, community guidelines, and policies. Violations on third-party platforms may result in enforcement within Ghost Chatter Network.

Chat, Direct Messages, and Conduct

You agree not to:

harass, threaten, or abuse others;
engage in illegal activity or promote it;
manipulate systems, metrics, rankings, leaderboards, or monetization features;
spam, scrape, or attempt unauthorized access to our systems or other users’ accounts.

Direct messages and other private communications are subject to these Terms, our moderation policies, and applicable law. We may review reports and take action on abusive or unlawful messages. Message delivery and related features may be subject to privacy settings you control in the App.

Moderation

We may remove content, limit features, or suspend accounts at our discretion, consistent with these Terms and our policies. We may use automated tools as well as human review to find and act on content that may break our rules.

Host Restrictions in a Live Stream

The host of a live stream can restrict a viewer in that live. A restricted viewer can keep watching that live but cannot interact with it: they cannot chat, send Gifts or highlighted chat, use the flashlight, submit audience questions, request or join as a guest or co-host, vote, or use any other viewer action in that live.

Platform Bans and Watch Restrictions

If we ban your account, or restrict it from watching live streams, you will not be able to watch live streams on Ghost Chatter Network, and a ban may also block other use of the App. To prevent ban evasion, we may also block devices and network (IP) addresses associated with banned accounts.

Enforcement Actions

If we reasonably believe you violated these Terms, our safety or community rules, our Virtual Items Policy, Creator Payout Policy, or applicable law, we may take proportionate action, including:

warnings, temporary feature limits, or account-level restrictions;
removal of content, comments, chat, direct messages, streams, replays, or other materials;
temporary or permanent suspension of account access;
temporary or permanent loss of live streaming privileges;
restrictions on sending or receiving gifts or other monetization interactions;
removal from leaderboards or Haunting Season rankings, or removal of leaderboard borders or badges;
holds, reversals, deductions, or forfeiture of virtual items, pending balances, or payout eligibility where permitted by law;
payout delays, cancellations, or additional verification or compliance checks;
permanent account termination in severe or repeat cases.

For safety, fraud prevention, or legal compliance, we may act immediately (including without prior notice where appropriate).

Investigation and Cooperation

We may investigate suspected violations, including abuse, fraud, chargebacks, fake engagement, or evasion through alternate accounts. You agree to provide accurate information we reasonably request for security, identity, age verification, tax, payout, or legal compliance purposes.

Child Safety and Evidence Preservation

We have zero tolerance for child sexual exploitation, grooming, or any sexualization of minors. Any user can report content or accounts for child-safety reasons, including watch-only accounts and accounts that are otherwise restricted.
When we remove content or suspend an account because of a child-safety concern (including an account used by someone under the required age), we hide the content from everyone and remove it from public playback, but we may keep a private, access-restricted copy of the content and related information (for example, account details, the reported content, related messages or chat context, reports, and device and network information). Access is limited to authorized Ghost Chatter administrators and every access is logged.
We keep these records for at least 365 days, or longer where required by law, requested by law enforcement, or needed for an ongoing investigation or legal claim ("legal hold"). After 365 days an authorized administrator reviews each record before anything is deleted; records are never deleted automatically.
We report apparent child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC) and may share preserved information with NCMEC and law enforcement as permitted or required by law, including 18 U.S.C. § 2258A.
Deleting your account does not delete records we are required or permitted to keep for child-safety purposes.

Effect of Suspension or Termination

If your account is suspended, deactivated, or terminated, access to App features (including live streaming and monetization tools) may be removed. Access to virtual items, pending balances, or payout features may also be restricted, reduced, reversed, or forfeited where permitted by law and applicable policy.

User-Generated Content Disclaimer

We are not responsible for user-generated content.
Content does not reflect our views.
You interact with others and with UGC at your own risk.

Platform Rules and Acceptable Use

You must: follow laws and these Terms; provide accurate information when required (including your date of birth and registration details).

You must not: break the law; harass or harm others; impersonate others; spam; hack or interfere with the App; provide false age or identity information; abuse Oracle or AI features to create illegal or harmful content; use the App for financial, medical, legal, or health-related decisions; manipulate ads, leaderboards or rankings, or circumvent technical or eligibility controls (including age gates, registration requirements, Go Live requirements, or monetization limits); use the App for unauthorized commercial purposes without our permission.

Live Gifts and Ghost Tokens (Virtual Items)

This section governs your purchase and use of Ghost Tokens and the sending of Gifts during live streams (and similar paid features such as highlighted chat, viewer flashlight control, and creator memberships) in the App. In the event of any conflict between this section and other parts of these Terms, this section controls with respect to Ghost Tokens, Gifts, and the creator rewards program—except that the Virtual Items Policy and Creator Payout Policy control their respective subjects as described in Relationship among policies below.

Nature of Ghost Tokens

Ghost Tokens are virtual items made available by Ghost Chatter within the App. They are not currency, legal tender, electronic money, stored value, credit on deposit, commodities, securities, or property.
When you buy a Token pack, you receive a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use Ghost Tokens within the App to send Gifts and other virtual items we make available from time to time.
Ghost Tokens have no monetary or real-world value. They cannot be redeemed for cash, goods, or services outside the App and cannot be sold, traded, gifted to other users' accounts, exchanged on any secondary market, or combined with other users' balances.
You do not own Ghost Tokens. We may at any time modify, suspend, revoke, forfeit, reset, or eliminate Ghost Tokens, Gifts, or the program as a whole, including without limitation if we determine you have violated these Terms, engaged in fraud or chargebacks, closed your account, or if we discontinue the program.

Purchasing Ghost Tokens

Token purchases are processed through Apple In-App Purchase (iOS) and Google Play billing (Android), as applicable, and are subject to the applicable store terms. We do not process payment credentials directly. We do not currently support web purchases of Ghost Tokens.
You must be 18 years of age or older (or the age of majority in your jurisdiction, whichever is older) to purchase Ghost Tokens. You represent and warrant that you meet this age requirement each time you purchase. Watch-only (13–17) accounts cannot purchase Ghost Tokens, and purchases attempted from such an account will not be credited. Apple and Google handle any refund requests for store purchases under their own policies.
Token pack prices, pack sizes, and availability are set by us and may change at any time, in our sole discretion.
All purchases are final and non-refundable except as required by applicable store policies or law. Refund, billing dispute, and chargeback requests must be made through the applicable store. Nothing in these Terms limits rights you have under applicable law that cannot be waived.
If a Token purchase is later refunded, reversed, or charged back for any reason, (i) the corresponding Ghost Tokens (or an equivalent amount from your then-current balance) may be removed from your account, and (ii) any creator rewards credited from that purchase may be deducted from the creator's balance or recovered from future balances. You authorize us to perform these reconciliations.
Unused Ghost Tokens are forfeited if you delete your account.

Sending Gifts

You can spend Ghost Tokens to send virtual Gifts during eligible live streams (and where otherwise enabled). Each Gift has a fixed Token cost set by us.
Gifts are a form of expression and digital appreciation. Sending a Gift is not a direct payment to the creator and does not create a contract, employment, agency, partnership, fiduciary, or financial relationship between you and the creator.
Creators do not guarantee any content, outcome, acknowledgment, response, performance, or benefit in exchange for Gifts. You should not send Gifts with the expectation of any specific return.
Once a Gift is sent and delivered, the Gift is considered consumed and the associated Ghost Tokens are non-refundable except as required by law.
You are solely responsible for your decision to send Gifts, the Gifts you choose, and the amount you spend.

Highlighted Chat

Where available, you can spend Ghost Tokens to send a highlighted chat message in a live stream, or a highlighted comment on a replay. Highlighted chat is a paid feature, and the Token cost is shown in the App before you send. Highlighted chat messages are subject to the same conduct rules and moderation as other chat, and are final and non-refundable once sent, even if the message is later removed for violating these Terms.

Viewer Flashlight Control

Where a host enables it, viewers can spend Ghost Tokens to toggle the host’s device flashlight during a live stream, subject to cooldowns. Flashlight actions are final and non-refundable and do not earn the creator rewards.

Creator Memberships

Creators may offer monthly or yearly memberships paid in Ghost Tokens. A membership renews automatically at the end of each period using Tokens in your wallet until you cancel it. If you don’t have enough Tokens when it renews, the membership lapses. Cancelling stops future renewals; you keep access until the end of the period you already paid for. Membership payments are non-refundable, including for the current period if you cancel, if you delete your account, or if the creator deletes their account or stops offering memberships.

Creator Rewards and Geographic Availability

Eligible creators may receive rewards from Ghost Chatter based on Gift and other eligible activity. Rewards are granted by Ghost Chatter, in its sole discretion, calculated on a fixed revenue-split basis (balances tracked in USD as described in the Ghost Chatter Creator Payout Policy), and are subject to that Policy. The Creator Payout Policy describes the current creator shares (for example, on Gifts, highlighted chat, and memberships, and that flashlight actions carry no creator share) and the payout schedule.
Ghost Chatter—not the viewer—is the entity that may pay rewards to eligible creators. Viewers do not owe, and creators do not have any legal claim against, any specific viewer for any Gift.
Creator rewards (payouts): Available to creators whose Stripe Connect Express onboarding (including any identity verification Stripe requires) is complete and Stripe lists a supported country of residence—currently United States, Canada, United Kingdom (Stripe code GB), and Australia—subject to Stripe and our eligibility rules. We plan to add more countries over time and will communicate expansions in-app and in the Creator Payout Policy.
Purchasing Ghost Tokens: Availability depends on store (Apple/Google) availability for your region and our product settings; not all territories may offer Token purchases at all times, regardless of creator payout regions.
Anyone with a full-access account may use Ghost Chatter Network to watch and interact where the App is available, subject to these Terms (watch-only accounts may watch but not interact); gifting and reward eligibility may still be limited by region, age, identity verification, Stripe status, or store rules.
Creator rewards are paid through Stripe Connect. By enabling payouts, creators enter into a separate agreement with Stripe in addition to these Terms and the Creator Payout Policy.

Prohibited Uses of Tokens and Gifts

You may not use Ghost Tokens, Gifts, or the creator rewards program to:

harass, threaten, defraud, coerce, extort, or manipulate any person;
circumvent geographic, age, identity verification, eligibility, or payment-system restrictions;
engage in money laundering, structured transactions, collusive gifting, bot-driven gifting, wash gifting, or any scheme intended to extract platform funds, artificially inflate creator earnings, or manipulate leaderboards;
facilitate transactions for goods or services that are illegal, infringing, or prohibited by these Terms or our Community Guidelines;
trade, sell, assign, exchange, or grant rights in Tokens or Gifts for anything of value outside the App;
attempt to reverse engineer, duplicate, mint, or otherwise fraudulently generate Tokens or Gifts; or
violate applicable law, including consumer protection, anti-money-laundering, sanctions, tax, or payments laws.

We may investigate suspected misuse; freeze, void, or reverse Tokens, Gifts, or reward credits; decline to pay rewards; suspend or terminate accounts; and report suspected unlawful activity to authorities.

Program Changes and Termination

We may add, change, or remove Tokens, Gifts, pricing, revenue-split percentages, reward mechanics, payout schedules, eligibility, geographic availability, or any related feature at any time, in our sole discretion.
If we materially change or discontinue the Tokens or creator rewards program, we will use commercially reasonable efforts to notify active users in-app or by email before the change takes effect.
On account closure (by you or by us) or on discontinuation of the Tokens program, any remaining Token balance may be forfeited and no refund is owed, except where refund is required by applicable law.

Taxes

You are responsible for any taxes that may apply to your Token purchases.
Creators are responsible for reporting and paying all taxes on rewards they receive. Stripe will issue tax forms appropriate to your country and Stripe’s rules (for example U.S. Form 1099-NEC when IRS thresholds apply). See the Creator Payout Policy for details.

Relationship to Other Documents

The Creator Payout Policy is incorporated into these Terms by reference and applies to creators who enable eligible monetization features. Apple and Google store terms govern Token purchases through those stores. The Stripe Connected Account Agreement governs creator payouts. If any of those documents conflict with these Terms on matters within their scope, those documents control as to their subject matter.

Relationship among policies (Virtual Items, Creator Payout, and these Terms)

Virtual items (including Ghost Tokens, Gifts, and related monetization features) are also governed by our Virtual Items Policy and Creator Payout Policy. If there is a conflict:

the Virtual Items Policy controls virtual-item purchase and usage rules;
the Creator Payout Policy controls creator balance and payout mechanics;
these Terms control general platform conduct and account access.

Policy violations may result in warnings, feature restrictions, suspension or termination, and where applicable may include limits or forfeiture affecting virtual items, creator balance, payout eligibility, and live streaming access, subject to applicable law.

Leaderboards, Winner Borders, and Haunting Season

Weekly leaderboards. Ghost Chatter Network has weekly leaderboards (for example, a main weekly board, Rising Stars, Top Streamers, and Top Creators) and an all-time board. Points are earned for specific actions (for example, going live, watch time on your lives, clip views, new videos you upload, supporters, and Gifts you receive), each with daily or weekly limits. The current point rules are shown in the App. Weeks run on Eastern Time.
Winner borders. Top finishers on a weekly board may receive a time-limited animated avatar border or badge for the following week. Borders and badges are for recognition only, are not purchases or virtual items, cannot be transferred, and expire automatically.
Haunting Season. Haunting Season is a monthly creator season. Creators earn season points from their live streams (for example, for qualifying lives, time on air, and streaming on several nights in a week) and move through season levels. Gifts and other purchases do not count toward season points.
Fair play. Leaderboard positions, points, levels, borders and badges have no cash value and are not prizes. We review results before they are final, and we may correct points, remove entries, or take away borders or badges earned through cheating, fake engagement, or other violations. Watch-only (13–17) accounts and banned or restricted accounts do not appear on leaderboards or in season rankings. We may change the boards, scoring, levels, awards, or period length at any time.

Premium Services and Subscriptions

Premium subscriptions (where offered) unlock investigation and App features such as AI voices, custom questions, and profile customization, as described in-product. Premium is not required to go live on Ghost Chatter Network.
Subscription products (such as Premium), where offered, auto-renew unless cancelled in accordance with store rules.
Subscriptions are managed through Apple or Google; pricing may vary by region and may change with notice as permitted by stores and law. Deleting the App or your account does not cancel a store subscription; cancel it in your Apple or Google account settings.
You must be 18 or older (or the age of majority in your jurisdiction) to purchase Premium or any subscription. Watch-only (13–17) accounts cannot purchase them.
Subscriptions are non-transferable and non-refundable except as required by law or store policy.
Free trials, where offered, convert to paid subscriptions unless cancelled as described at purchase.
Premium tiers may reduce or remove ads as described in-product.

Notifications

The App may send in-app and push notifications (for example, when an account you follow goes live or posts a video, for messages and replies, for leaderboard results, and for account and safety notices). Push notifications are delivered through push notification services provided by Apple and Google. You can manage notification preferences in the App and in your device settings.

Oracle Feature Terms

Sensor Monitoring

Oracle may use device sensors (such as a magnetometer) for entertainment-oriented features.
Sensor readings are processed locally on your device where designed to do so; sensor readings are not scientific proof of paranormal activity.

AI Image Generation

Oracle may generate AI images based on words or prompts, including through third-party AI services (e.g., Stability AI).
Generated images may be stored locally on your device unless otherwise disclosed in-product.
AI-generated images are artistic interpretations, not evidence of actual events. You may not use AI-generated images for commercial purposes without permission.

Custom Word Banks

You may create custom word categories where the feature is available. You are responsible for your content. We may filter or remove inappropriate words.

Oracle Disclaimers

Oracle is for entertainment only. Do not use Oracle for financial, medical, legal, health-related, or safety-critical decisions. Do not use Oracle in ways that could cause harm to yourself or others.

Advertising Terms

The App may include advertisements (including rewarded ads) to support free features.
Ads are delivered through Google AdMob (iOS and Android); on Android, AdMob may also fill ads from Unity Ads and Meta Audience Network through mediation. Those networks have their own terms and privacy policies.
For users under 18, ads are requested as non-personalized and limited to content suitable for teens.
Ad viewing may be optional depending on the feature. Premium tiers may reduce or remove ads as described in-product.
You may limit ad tracking through your device settings where available (for example, App Tracking Transparency on iOS).

Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference. We collect and process data as described there, including for registered accounts, age verification, Ghost Chatter Network, security, operations, and compliance. Ad networks may collect data as described in the Privacy Policy. No method of transmission over the internet is 100% secure.

Intellectual Property

The App and its content are owned by us or our licensors. Our trademarks and logos are our property. You may not use our intellectual property without permission. You retain ownership of content you create; you grant us a license reasonably necessary to operate the services. Third-party services are subject to their respective terms.

Disclaimers and Limitation of Liability

App Disclaimer

The App is provided "as is" without warranties of any kind to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation.

Paranormal and Spirit Box

The App is for entertainment and educational purposes. We do not claim real communication with spirits or entities. Spirit Box and similar features may produce coincidental or subjective outputs—do not rely on them for important decisions.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for claims relating to the App is limited to the greater of (a) amounts you paid to us for the App or subscriptions in the twelve (12) months before the claim, or (b) USD $100, except where prohibited by law.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum permitted.

Indemnification

You agree to indemnify and hold harmless Ghost Chatter LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your content, your violation of these Terms, or your violation of third-party rights.

Termination and Account Deletion

By You

You may stop using the App at any time. You can permanently delete your Ghost Chatter account in the App on iOS and Android (Profile Settings > Account > Delete account). If you can’t access the App, you can ask us to delete your account at info@ghostchatterapp.com. Account deletion cannot be undone. When you delete your account:

any Ghost Tokens left in your wallet are forfeited;
if you are a creator with unpaid earnings and no payout account set up, those earnings are forfeited (the App asks you to confirm this separately); if you have a payout account set up, earnings you have already made are paid out on the normal schedule under the Creator Payout Policy;
memberships you pay for are cancelled, and memberships fans hold with you stop renewing; no one receives a refund for the current membership period;
we keep payment and transaction records, safety and enforcement records, and child-safety records, as described in the Privacy Policy.

Deleting the App from your device does not delete your account.

By Us

We may suspend or terminate accounts for violations of these Terms, fraud, illegal activity, risk to safety, or as required by law. We may discontinue features or the App with notice where reasonable.

Modifications to Terms

We may update these Terms from time to time. We will use commercially reasonable efforts to notify you of material changes through the App or by email. Continued use after the effective date may constitute acceptance. If you do not agree, you must stop using the App.

Governing Law and Venue

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles. To the extent permitted by applicable law, disputes will be resolved exclusively in the state or federal courts located in Michigan, and you consent to personal jurisdiction there.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, Virtual Items Policy, and Creator Payout Policy (each as applicable), constitute the entire agreement between you and Ghost Chatter LLC regarding the App to the extent described herein.

Acknowledgment

By using the App, you acknowledge that:

You have read and understood these Terms and agree to be bound by them.
You are at least 18 years of age for full access; or you are 13 to 17 and your parent or guardian has given permission for a watch-only account; and you are at least 18 years of age (or the age of majority in your jurisdiction) to purchase Ghost Tokens or Premium or receive creator rewards.
You will use the App responsibly.
Oracle and similar features are for entertainment purposes only; you will not use them for important decisions.
Ghost Tokens are virtual items with no monetary value, may be revocable, and purchases may be non-refundable as described herein; sending a Gift is not a direct payment to a creator.
Going live does not require a Premium subscription but does require a full-access (18+) account and meeting the Go Live requirements.
